Thanks all. Yes, I can appeal but I have no idea of costs. I don't even know yet what I am liable for already, let alone what they might be if I were to lose an appeal as well.

Tough day today, but life goes on.

Hi Bob,

Commiserations; it's always a tough day, particularly when you're the little guy.

This may come as no consolation but I won a case in the Court of Appeal here a few years ago. That's not an easy thing in English law as, unlike Spain possibly, few cases are accepted for appeal. You can't just automatically appeal. Having lost badly at first instance - after nearly five days in court - with some County judge, the son of a law lord himself, pontificating and lecturing me on matters that were none of his business, I felt pretty outraged, much as you do now presumably. To cut a long story short, I sacked my solicitors and started again. The point is this; that I felt the true facts still supported me, not some aberrant judge's distorted interpretation of them. If you consider the same, then go for it. With a much better solicitor and leading barrister, I eventually won through. With a bit of luck and determination, it is possible. The facts as you report them look as though you've been gipped and I can well appreciate the shark soup you're swimming in with off the plan property schemes.

Thanks for all the support everyone. Despite being disappointed, I am over it now. I am no worse off than I was a couple of weeks ago.

I have taken the decision to appeal. Apparently the appeal process is cheaper than this initial process. Neither side can add any new documents to their declarations and so there is no additional legal work. It is really just a case of asking a more senior judge for a 2nd opinion.

The down side is that an appeal hearing is likely to be at least a year away. But I have to try.

 Good luck Bob and that is the right way to approach it. In my job, I get a commission element to my fees; I used to calculate the potential upside and was always disappointed as the reality would be the number would fall short. Much better to assume nothing and then take what comes in as a bonus!
